Short answer. From inside New York, Polymarket, ProphetX and Kalshi are the platforms we recommend, and OG and Novig are available in New York too. New York is suing Kalshi (since July 31, 2026) and Polymarket (since September 24, 2026); both still accept New Yorkers and the cases are pending. Sleeper, Chalkboard and Rebet are travel-only for New Yorkers — legal to use only while physically located in an eligible state.

   CFTC issues interim final rule excluding casino-style gambling products from the definition of swap

   The CFTC issued an interim final rule writing into its regulations its position that "casino-style gambling products", such as wagers placed at sportsbooks and on casino games, are not swaps. The rule is final but not yet in effect: it takes effect when it is published in the Federal Register, and it had not been published there as of October 13, 2026.

2. October 9, 2026 Federal

   CFTC proposes to include event contracts in the definition of swap

   In a separate notice of proposed rulemaking, the CFTC proposed to define "swap" expressly to include event contracts, including those based on sports, politics, cultural and weather-related events. This is a proposal, not a final rule: public comments are due 30 days after it is published in the Federal Register.

3. September 25, 2026 Federal

   Sixth Circuit rules against Kalshi in Ohio and Tennessee appeals

   The court held that Kalshi had not shown its sports event contracts are swaps and that federal commodities law does not preempt Ohio or Tennessee gambling laws. Both cases go back to the district courts. The ruling does not bind New York.

4. September 24, 2026 New York

   New York sues Polymarket US in state court

   The Attorney General and the Governor announced a lawsuit against QCX LLC, doing business as Polymarket US, alleging it runs an unlicensed gambling operation. The suit asks for an order stopping it from operating in the state, plus fines, forfeiture of gains and restitution.

5. September 24, 2026 New York

   Polymarket reported to have filed its own suit against New York

   Sports Betting Dime reported that Polymarket filed a countersuit the same day New York sued it, asking for preliminary and permanent injunctions against enforcement of state gambling laws on its sports event contracts.

6. September 14, 2026 New York

   DeFi Rate reports a hearing on the CFTC's request to block New York enforcement

   DeFi Rate reported that a judge in the Southern District of New York heard the CFTC's request for a preliminary injunction against New York officials and appeared skeptical. This is a press report; the request has not been decided.

   Crypto.com reported to have asked the Supreme Court to review the Ninth Circuit ruling

   Sports Betting Dime reported that Crypto.com filed a petition the previous week, joining Robinhood in asking the U.S. Supreme Court to decide whether federal commodities law preempts state regulation of sports event contracts.

   Kalshi reported to seek Ninth Circuit rehearing; Robinhood petitions the Supreme Court

   Sports Betting Dime reported that Kalshi asked the full Ninth Circuit to rehear its Nevada case, while Robinhood filed a petition asking the U.S. Supreme Court to review the same ruling.

   New Jersey asks the U.S. Supreme Court to review the Kalshi preemption ruling

   The New Jersey Attorney General filed a petition asking the Supreme Court to decide whether prediction markets can offer sports contracts without following state sports-gambling laws. The Court has not said whether it will hear the case.

    Ninth Circuit rules for Nevada regulators in Kalshi case

    In KalshiEX v. Assad, a three-judge panel upheld the dissolution of an injunction that had protected Kalshi in Nevada, finding Kalshi had not shown that federal commodities law likely preempts Nevada gaming rules for its sports event contracts. The ruling does not bind New York.

    New York City Council opens inquiry into prediction market advertising

    The Council announced an investigation into operators' marketing practices, with a focus on advertising directed at young people.

    CFTC issues emergency order telling Kalshi to keep operating

    After Kalshi told the CFTC that New York's state-court lawsuit had created a market emergency, the agency used its emergency authority to order the exchange to continue operating under federal core principles. The CFTC said the state suit seeks a nationwide restraining order and more than $36 billion.

    Novig sues New York

    Novig filed a federal lawsuit against the New York Attorney General and members of the State Gaming Commission, asking for an injunction to prevent the state from enforcing its gambling laws against Novig's sports event contracts.

    New York sues Kalshi in state court

    The Governor and the Attorney General announced a state-court lawsuit alleging Kalshi operates an unlicensed gambling business. It seeks a court order to stop it and to recover fines, illegal gains and restitution for users.

    Federal court reported to reject Kalshi's bid for an injunction pending appeal

    CDC Gaming reported that the U.S. District Court for the Southern District of New York rejected Kalshi's emergency request for an injunction while it appeals.

    Federal judge denies Kalshi an injunction against New York regulators

    U.S. District Judge Analisa Torres denied Kalshi's request for a preliminary injunction against the New York State Gaming Commission, finding New York gambling laws are not preempted as applied to Kalshi's sports contracts. Kalshi appealed.

    Novig announced that the CFTC designated its exchange as a Designated Contract Market. The CFTC register lists Ludlow Exchange, LLC, named in press reports as Novig's exchange subsidiary, as designated on the same date.

    CFTC designates ProphetX LLC as a contract market

    The CFTC register of trading organizations shows ProphetX LLC as a designated contract market as of June 11, 2026. Trade press reported that it was also approved as a derivatives clearing organization the same day.

    CFTC proposes a framework for sports and other "enumerated activity" contracts

    The CFTC published a proposed rule amending Regulation 40.11 to set out how it would evaluate event contracts involving gaming, including contracts on sporting events. The proposal was opened for public comment and is not final.

    New York Senate committee reported to advance a bill restricting prediction markets

    Sports Betting Dime reported that Senate bill S9414, which would prohibit event contracts on sports, politics and certain other topics and raise the minimum age to 21, was reported out of the Racing, Gaming and Wagering Committee and sent to the Finance Committee. It has not become law.

    CFTC sues New York over enforcement against prediction markets

    The CFTC filed suit in the Southern District of New York seeking a declaration that federal law gives it exclusive authority over event contracts and a permanent injunction against state enforcement of gambling laws on its registrants.

    The New York Attorney General joined a bipartisan group of attorneys general in a brief to the Massachusetts Supreme Judicial Court arguing that Kalshi must follow state gambling laws.

    The Attorney General sued Coinbase Financial Markets and Gemini Titan, alleging their prediction markets are unlicensed gambling operations under New York law and seeking fines, forfeiture of profits and restitution.

    Third Circuit sides with Kalshi against New Jersey regulators

    In KalshiEX v. Flaherty, a divided panel upheld an injunction blocking New Jersey from enforcing its gambling laws against Kalshi's sports event contracts, finding Kalshi had a reasonable chance of showing federal law preempts state law. One judge dissented. The ruling does not bind New York.

    New York Attorney General reported to issue a consumer alert on prediction markets

    Sports Betting Dime reported that, ahead of the Super Bowl, the Attorney General warned New Yorkers that prediction markets do not carry the same consumer protections as licensed platforms and cautioned operators about unlicensed sports wagering.
