What to know

  • Michigan: Sports contracts blocked by court order. A Michigan court preliminary injunction signed 1 September 2026 requires Kalshi to block sports contracts in Michigan, with a $500,000-a-day penalty; other Kalshi markets are not covered by the order (Sports Betting Dime).
  • Nevada: Sports contracts blocked by court order. Kalshi must keep sports, election and entertainment contracts switched off in Nevada under a state-court preliminary injunction (entered 18 May 2026) and an agreement with regulators filed on 23 July 2026 and announced on 24 July 2026; other Kalshi markets remain open there (Las Vegas Review-Journal).
  • Washington: Sports contracts blocked by court order. Under a Washington court preliminary injunction, Kalshi has blocked sports, election, politics, entertainment, culture, tech/science and mention contracts for Washington users since 19 August 2026; commodities, climate, economics and finance markets remain open (Sports Betting Dime; Washington Attorney General).
  • New York: Available — dispute pending. Kalshi's appeal is at the Second Circuit (case 26-1835), where New York's brief is due 30 October 2026. New York sued Kalshi in state court on 31 July 2026; on 7 July 2026 a federal judge had found New York's gambling laws are not preempted for Kalshi's sports contracts. On 11 August 2026 the CFTC issued an emergency order telling Kalshi to keep operating (CFTC release 9281-26). No court order blocks Kalshi in New York.
  • Massachusetts: Available — dispute pending. A Massachusetts judge ordered Kalshi to stop sports contracts in January 2026, but an appeals judge paused that order on 17 February 2026 while the state's highest court decides Kalshi's appeal (argued 4 May 2026); Polymarket has also sued the state (Bloomberg Law).
  • New Jersey: Available — dispute pending. Kalshi accepts New Jersey residents under a federal court injunction that protects it; the Third Circuit upheld that preliminary injunction on 6 April 2026 and New Jersey has asked the Supreme Court to review it (No. 26-299) (Third Circuit opinion).

Federal picture: federal appeals courts are split on sports event contracts, all at the preliminary-injunction stage: the Third Circuit sided with Kalshi (6 April 2026), the Ninth (28 August 2026) and Sixth (25 September 2026) sided with the states, and three Supreme Court petitions (Nos. 26-299, 26-338, 26-344) are pending; none has been granted.
